National Wills Week is around the corner and DTS Attorneys will be participating. Wills Week is a Law Society Initiative where any person will be provided the service of having a basic will drafted free of charge.

Making a Last Will and Testament allows you to control how your assets are distributed after your death, ensuring that only your chosen beneficiaries’ benefit. Without a will, your assets will be divided according to the Law of Intestate Succession, subjecting them to general rules that may not align with your wishes. A well-planned will minimizes financial disruption to your loved ones and ensures your assets are left in the right hands.

Dying without a will means:

  • Assets are distributed according to the Law of Intestate Succession
  • The Master of the High Court appoints an executor, possibly not your choice
  • Assets are divided between your spouse and children in fixed percentages, disregarding individual circumstances
  • A guardian may be appointed for your children without your input
  • The state controls monies due to minor children
  • Estate winding-up may be delayed, causing financial problems for your family
